Length of annual leave in labor law – 20 or 26 days?

Every employee employed under an employment contract has the annual, paid and uninterrupted right to annual leave guaranteed by the Labor Code. The amount of this leave is not the same for everyone and depends directly on the employee's overall length of service (so-called leave length). Polish law provides for two basic amounts of annual leave in a calendar year:

  • 20 days of leave:is granted to employees whose seniority is shorter than 10 years.
  • 26 days of leave:is available to employees with at least 10 years of service.

The length of service, which determines the amount of leave, includes not only periods of previous employment under an employment contract, but also periods of study at secondary schools and universities. These periods do not add up - the most favorable option for the employee is selected.

Periods of study included in the length of service (holiday period)

Pursuant to Art. 155 of the Labor Code, a certain period of time is included in the employment experience due to graduation from school. These periods cannot be added up:

Proportional leave and part-time work

In the case of part-time employees (e.g. half-time), the amount of leave is determined in proportion to the working time of the employee, taking as the basis the amount of leave he is entitled to (20 or 26 days). A partial day of leave is rounded up to a full day in favor of the employee:

  • For 20 days for part-time work:20 × 0.5 = 10 days of leave.
  • For 26 days for part-time work:26 × 0.5 = 13 days of leave.
  • For 26 days of 3/4-time work:26 × 0.75 = 19.5 -> 20 days of leave(after rounding).

Frequently asked questions (FAQ)

How many days of holiday am I entitled to per year?

It depends on the length of work (including completed schools). If your seniority is less than 10 years, you are entitled to 20 days of leave per year. If it is 10 years or more, you are entitled to 26 days.

Do bachelor's studies count towards leave?

Yes. Completing a bachelor's, engineer's or master's degree automatically gives you 8 years of work experience counted towards the leave (a diploma of completion is required).

Do periods of work and study add up to the holiday period?

No. If you worked under an employment contract during your studies, the internship includes either 8 years of graduation or the actual duration of employment - depending on what is more advantageous for the employee.

What is pro-rata leave?

This is leave accrued when an employee begins or ends work during the calendar year. The amount of leave is calculated in proportion to the months worked (e.g. 1/12 of the annual allowance for each month of work).

What is leave on demand and does it increase the amount of leave?

On-demand leave is a part of your annual leave (maximum 4 days a year), which the employer is obliged to grant upon notification no later than on the day the leave begins. These 4 days are not additional days - they are part of the pool of 20 or 26 days.
